ORDER
Order No.
03. 09.07.2026
(Through hybrid Mode)
1. This CRLMP has been filed for a direction to the Opposite Parties to hand over the investigation of Kamakhyanagar P.S. Case No.61 of 2024 which corresponds to G.R. Case No. 117 of 2024 in the Court of learned S.D.J.M., Kamakhyanagar, to the Crime Branch or direct for a fair and impartial investigation in the case.
2. As it was averred in Paragraph-4 of the CRLMP, that though the case had been registered, but the local police was intentionally not taking further action against the accused persons and not recovering the amount belonging to the
Petitioner and more than two years had elapsed in the meanwhile, but final form had not yet been submitted, the learned State Counsel had been directed by order dated 21.05.2026 to obtain instructions regarding status of the investigation.
3. Thereafter, the case was adjourned to 02.07.2026 when it was adjourned to today as instructions had not been received.
4. Today, when the matter is taken up, Mr. S. J. Mohanty, learned Additional Standing Counsel submits that specific instructions have not been received from the IIC, Kamakhyanagar Police Station, but the latter has sent the case diary from which it is apparent that after completion of investigation charge sheet No. 600 dated 03.12.2025 has been filed under Section 381/468/471 of the IPC against one Anil Kumar Dehury.
5. Since, it is apparent that almost five months, before filling of the CRLMP, the investigation had been completed, the Petitioner should have been more careful before rushing to the Court and raising incorrect allegations regarding inaction of the police in investigating into the case.
6. As the Petitioner has rushed to this Court making incorrect allegations regarding inaction of the local police in completing the investigation in Kamakhyanagar P.S. Case No.61 of 2024, the case is disposed of without issuing any direction but imposing cost of Rs.500/- on the Petitioner to be deposited in the Library of the High Court Bar Association within a period of four weeks, so that he and other litigants are cautious before rushing to this Court without verifying facts and making baseless allegations.
