ORDER

07.07.2026

03. (Through Hybrid Mode)

1. Instructions dated 06.07.2026 of the IIC, Athagarh Police Station is produced by Mr. S.J. Mohanty, learned Additional Standing Counsel where it is stated that Athagarh P.S. Case No.146 dated 11.04.2026 has been registered under Sections 126(2)/296/115(2)/351(2)/3(5) of the BNS against the present Petitioner and his father Bhikari Behera as well as Bhagyalaxmi Behera, the sister of Petitioner No.1 and after completion of the investigation charge-sheet dated 31.05.2026 has been submitted against the Petitioner and his father Bikari Behera. The allegations regarding abuse and assault by Suryakant Behera and his family members near jail chawk is not based on fact. However, it has also been stated in the instructions that on further enquiry it was learnt that the dispute between the two families has been amicably settled and the accused-husband Suryakant Behera and the complainant- Bhagyalaxmi Behera are now staying together.

2. In view of the settlement between the parties and instructions that the husband and the complainant-Bhagyalaxmi Behera are staying together, I do not consider it in the interest of justice to direct the Opposite Party No.4 to register any case as per the complaint of Petitioner which is at Annexure-1.

3. Hence, the CRLMC is disposed of without issuing any direction.
