ORDER

06.07.2026

05. (Through Hybrid Mode)

1. This CRLMP has been filed praying for a direction to Opposite Parties No.2 and 3 to take immediate direction against Opposite Parties No.4 to 11.

2. On 25.06.2026 after hearing the learned counsel for the parties, especially the submission of the learned counsel for the Petitioner that the accused persons are not allowing the Petitioner to enter her house for which she has not been able to produce her wearing apparels or the CCTV footage and that if the Police accompanies her to her house, she will be able to enter her house and produce CCTV footage as well as her wearing apparels, it was directed that on 01.07.2026 or 02.07.2026 the IIC, Baliapal Police Station will accompany / escort the victim to her residence to enable her to retrieve the CCTV footage as well as the wearing apparels.

3. The relevant portion of the order is extracted below:

“6. Mr. J.K. Mishra, learned counsel for the Petitioner submits that the accused persons are not allowing her to enter her own house for which she has been unable to produce her wearing apparels or the CCTV footage. If the Police accompany her to her house, then she will be able to enter the house and produce the CCTV footage as well as the wearing apparels.

7. It is therefore directed that on 01.07.2026 the IIC, Baliapal Police Station shall accompany / escort the victim to her residence at village-Biripalia, P.S.-Baliapal, District-Balasore to enable her to retrieve and produce the CCTV footage of the occurrence date as well as her wearing apparels. If for any reason, it is inconvenient to escort her to the house on 01.07.2026, it shall done on 02.07.2026 without fail.”

4. In his instructions dated 04.07.2026 of the IIC, Baliapal Police Station has stated that he waited in the Police Station on 01.07.2026 as well as on 02.07.2026. When the Petitioner- complainant did not appear, in the afternoon of 02.07.2026, he called on her registered mobile number but she stated that as she is not in Baliapal and presently at Balasore, she could not appear in the police station to proceed to the spot house. It is further stated that since she did not cooperate, neither the CCTV footage nor wearing apparels of the victim could be seized.

5. Mr. J.K. Mishra, learned counsel for the Petitioner submits that he had informed the Petitioner that Police would accompany her house on 02.07.2026 and thereafter he has not contacted the Petitioner.

6. In view of the conduct of the Petitioner, no useful purpose will be served by keeping this CRLMP pending. The CRLMP is disposed of directing that if the Petitioner gives prior notice to the Police about the date on which she will come in the Police Station, so that the I.O. can accompany / escort her to her house on the said date along with a lady constable (if the I.O. is a male).

7. As it is alleged that on account of political pressure, case was registered on 26.01.2026 even though complaint was made on 22.01.2026 by the Petitioner and that no steps have been taken against the accused persons who are roaming about freely threatening the Petitioner and her family members, for which they are unable to go to their house, the Opposite Party No.2 S.P., Balasore is directed to supervise the investigation and if he is satisfied after perusal of the case records, change the I.O. in the case.

9. With the above observations and directions, the CRLMP is disposed of.
