ORDER

Order No.

02. 06.07.2026

(Through hybrid Mode)

1. This CRLMP has been filed with the following prayer:

“The petitioner therefore prayed that your Lordship may graciously be pleased to issue notice to the Opp. Parties and call for records and direct to Opp. Party No. 2 and 3 for investigation and take necessary legal action against the accused person and arrest to the accused person/ O.P. No.4 of Tigiria Missing Person Regd. No. 40/2026 dated 30.5.2026 for the interest of justice; And this Hon'ble Court may kindly be directed to the Opp. Party No.2 and 3 to recover the petitioner's wife and son as soon as possible by this Hon'ble Court;

And pass any other order/orders, direction/directions, writ/writs as the Hon'ble Court deems fit and proper; And for which act of kindness, the petitioner shall as in duty bound, ever pray.”

2. Pursuant to order dated 23.06.2026, instructions dated 06.07.2026 of the IIC, Tigiria Police Station are produced. It is stated therein that during enquiry, the ASI found the missing lady along with her son in the house of one Abar Ahmad @ Kanha. She stated that she had left the house of the petitioner as she was unable to bear the physical abuse and torture by her husband and in-laws. She also stated that Abar Ahmad did not know that she had left her home and after leaving her home, she had called him to come and take her. She has also stated that the child is still breastfeeding, so she cannot leave the child with his father and that she and her child are being taken good care by Abar Ahmad and his family and that she does not want to return to her husband.

3. Considering the said instructions, I am of the view that no direction should be issued to the Opposite Party to register any case on the complaint dated 30.05.2026 on the basis of which MMR No. 40 of 2026 has been registered.

4. With this observation, the CRLMP is disposed of.
