ORDER
03.07.2026 The short grievance of the Petitioner-borrower is as to long pendency of his SA No.46 of 2017 despite there being direction by the DRAT in Appeal No.169 of 2018 disposed off on 27.04.2022.
2. Learned counsel for the Petitioner submits that in the hierarchical system of authorities, the one in the lower hierarchy has to obey directions of the other in the higher hierarchy, subject to all just exceptions and therefore, DRT is not justified in keeping the matter pending indefinitely. He also tells us that speedy justice is the requirement of Article 21 of the Constitution of India in the light of a catena of decisions of Apex Court.
3. Learned Panel Counsel appearing for the Bank although initially opposed the petition, now, signifies his consent for early disposal of the SA on merits, keeping open all contentions of the parties. This is appreciable. In the above circumstances, petition is disposed off requesting DRT to hear and dispose off SA No.46 of 2017 preferably within an outer limit of three months, all contentions of the parties being kept open. It is open to the Petitioner to seek return of the security documents depending upon the outcome of the SA.
Now, no costs. Web copy of this order to be acted upon by all concerned.
