ORDER

02.07.2026

04. (Through Hybrid Mode)

1. The CRLMP has been filed for issue of direction to the Opposite Parties to take steps as per law in Tangi P.S. Case No.26 of 2026 and apprehend the FIR named accused persons.

2. Mr. Bijay Jena, learned counsel for the Petitioner submits that one Basant Maharath instead of being arrested has been released by the I.O. after being called to the Police Station even though case has been registered under Section 109 of the BNS.

3. Pursuant to order dated 19.05.2026, the Opposite Party No.3-IIC, Tangi Police Station has filed an affidavit in reply to the averments contained in the CRLMP.

4. Perused the affidavit filed by the IIC, Tangi Police Station.

5. In paragraph-5 of the affidavit it is stated that injury requisition in respect of injured Laxmidhar Swain, Somnath Barik, Chandra Shekhar Jena, Niladri Bhushan Panda, Manas Ranjan Routraya and Jaga Mallik had been sent to the Medical Officer, CHC, Tangi on 10.01.2026 and the injury opinion was received on 15.05.2026. The Medical Officer has found abrasion injury of Chandra Sekhar Jena, bruise and swelling injury of Jaga Mallick, swelling injury of Niladri Bhusan Panda, no injury of Somanath Barik and Manas Ranjan Routray, abrasion injury of Laxmidhar Swain and he has seized six numbers of wooden Lathi used by the accused persons from the spot. Report under Section 126 of the BNSS has been issued against the villagers of Brusabandha. Investigation is pending as there is local tension and that investigation will be completed soon.

6. After going through the averments in the CRLMP and the Annexures, I find that the Petitioner has sent a number of petitions to the mining officer but has not approached the S.P., Khurda with his grievance.

7. I am therefore of the view that it is not necessary to issue any direction at present to the Opposite Parties.

8. The CRLMP is therefore disposed of granting liberty to the Petitioner to approach the Superintendent of Police, Khurda in case he is aggrieved by the investigation or if there is delay in completion of investigation.
