ORDER

02.07.2026

06.

1. Undeniably, the petitioner has deposited the entire amount pertaining to a Minimum Guaranteed Quantity (MGQ), but was not permitted to lift the shortfall and/or the balance quantity.

2. In course of the hearing, it is an admitted position that the initial period of licence granted to the petitioner expired on 30th June, 2026. Naturally, the moment the licence expires, it does not clothe any right into the licensee to lift the MGQ, but in course of the hearing, it is submitted by learned counsel appearing for the petitioner that she is also adjudged as a successful bidder for the ensuing five years and, therefore, she is not precluded from running the country liquor shop from the premises where she continued the operation under the previous licence.

3. In the event, the petitioner is granted a further licence as submitted before us then, in such situation, the petitioner should be permitted to withdraw the shortfall of the MGQ in addition to the MGQ earmarked for the current year.

4. The writ petition is accordingly disposed of.
