ORDER

30.06.2026

02. The period prescribed for making payment, in terms of order dated 19.06.2026, is extended by two weeks. Petitioner- borrower is knocking at the doors of this Court with the following prayer:

“The petitioner, therefore, prays that this Hon'ble Court may graciously be pleased to admit the writ petition, issue RULE NISI, calling upon the Opp. Party to show cause as to why the notice dt. 30/05/2026 under Annexure- 1 shall not be quashed; And if the Opp. Party fails to show cause or shows insufficient cause, the said Rule be made absolute…;

2. Learned Panel Counsel appearing for the Bank points out that the auction of the security property having been held on 19.06.2026, the buyer has already deposited 25% of the auction money and will deposit the remainder within the prescribed period under Rule 9(4) of the Extended Rules. He also submits that the Petitioner has got an alternate remedy under Section 17 of the

2002 Act and therefore, in the absence of extra ordinary circumstances, interference of the Writ Court is unwarranted. We agree.

In the above circumstances, Petition is disposed off reserving liberty to the Petitioner to work out his remedy elsewhere as indicated above. In that connection, all contentions are kept open.

Web copy of this order to be acted upon by all concerned.
