ORDER

30.06.2026

02.

1. The instant writ petition has been filed by the petitioner seeking the following reliefs:

“The petitioner, therefore, prays that your Lordships would be graciously pleased to admit this writ petition, call for the records and after hearing the parties allow the same, issue writ/writs in the nature of certiorari/mandamus and/or any other further writ/direction and direct the Opposite Party No.2 & 3 to ratify and regularise the Quarry Lease Agreement dtd.12.04.2022 under Annexure-6 in favour of the Petitioner in respect of Hatia Building Stone Quarry (GHA), Nijagadatapanga present at Khata No.832/1, Plot No.277 (P), Ac.6.000 dec., Tahasil Khordha.”

2. It appears from the reliefs so claimed that the petitioner sought for rectification of the terms and conditions embodied in the said lease deed on the premise which is vividly and/or lucidly indicated and/or pleaded in several paragraphs in seriatim. However, the learned Addl. Government Advocate submits in the midst of hearing that the said lease deed has already been cancelled, and, therefore, the reliefs claimed herein becomes inappropriate.

3. In view of the fact that the lease has already been cancelled, for which the rectification was sought for, the instant writ petition becomes infructuous, and, accordingly dismissed. However, dismissal of the writ petition shall not prevent the petitioner to challenge the order of cancellation of the lease deed in a validly instituted proceeding before the appropriate forum.
