01. Heard learned counsel appearing for the Petitioner.
The short grievance of the Petitioner-Bank is as to long pendency of its S.A. No.52 of 2025, pending on the file of Debt Recovery Tribunal, Cuttack.
Learned counsel for the Bank vehemently argues that right to speedy justice being one of the facets of Article 21 of the Constitution of India vide catena of decisions of the Apex Court, early disposal of the subject S.A. is eminently desirable. We agree with this.
In the above circumstances, no notice being issued to the other side, who will have an opportunity of hearing in the said S.A. when it is taken up for consideration, the DRT is requested to hear and dispose off the said S.A. preferably within a period of three (03) months, all contentions having been kept open.
Accordingly, this Writ Appeal is disposed off.
