ORDER

Order No.

02. 29.06.2026

(Through hybrid Mode)

1. This CRLMP has been filed to direct the Opposite Party No.3 for proper investigation and to arrest of accused person and submit charge sheet in connection with Pattamundai Rural PS Case No. 235 of 2026.

2. The case has been registered on 23.04.2026 under Section 296,326(f), 351(2),351(3) and 3(5) of the BNS against Judhistira Sandha, Satyaranjan Sandha, Biswaprakash Sandha and Ajaya Sethi.

3. Pursuant to order dated 22.06.2026, where the learned Additional Standing Counsel had been directed to obtain instructions and the up-to-date case diary, the case diary in Pattamundai Rural PS Case No. 235 of 2026 is produced by Mr. S. J. Mohanty, learned Additional Standing Counsel.

4. Perusal of the case diary reveals that after registration of the FIR on 23.04.2026, examination of some witnesses had been done on 23.04.2026 and 24.04.2026. Thereafter, virtually there has been no investigation in the case. There are some entries on 10.05.2026 in CD No. III and on 18.06.2026 in CD No. IV. But the entries are almost identical except for verification regarding CCTV camera and on 24.04.2026, there is an entry in the case diary that requisition was made to the fire station, Pattamundai providing detailed information about “firing” of cowshed of complainant. But copy of the said requisition is not available in the case diary.

5. Mr. P. K. Mishra, learned counsel for the Petitioner submits that Husband of the petitioner and her minor daughters have not been examined during investigation. The IO has not visited the spot and no action has been taken against the accused persons who are moving about freely and threatening the Petitioner and her family members. The Petitioner has sent a grievance petition to the Superintendent of Police, Kendrapara.

6. There is however no endorsement or any document showing that the said petition has been sent to or received in the Office of the SP, Kendrapara.

7. Perusal of the case diary reveals the said allegation regarding non-examination of the husband and daughters of the Petitioner are correct.

8. Hence, the CRLMP is disposed of granting liberty to the petitioner to submit a fresh grievance petition before the SP, Kendrapara within one week, which shall be considered by the SP, Kendrapara in accordance with law.

9. If deemed necessary, police protection may be given to the petitioner and her family members as the accused persons have not been arrested till date and the Petitioner has alleged that they are threatening her.
