ORDER

02.
1. The Petitioner faces trial being accused in G.R. Case No.434 of 2018 corresponding to Koida P.S. Case No.63 of 2018 pending before the learned S.D.J.M., Bonai, Sundargarh.
2. By filing the present TRPCRL the petitioner seeks transfer of the G.R. Case No.434 of 2018 to the Court of learned S.D.J.M., Dhenkanal ‘for the interest of justice’ from the court of learned S.D.J.M., Bonai.
3. The learned counsel for the Petitioner was requested to apprise this Court under which provision the choice of the accused in a trial is the criteria for directing transfer of the trial from the jurisdictional court to another court.
Learned counsel for the Petitioner submits that now the Petitioner resides within jurisdiction of the learned S.D.J.M., Dhenkanal. Due to distance between Dhenkanal and Bonai the matter should be transferred to Dhenkanal.
4. The learned counsel for the Petitioner is apprised of the fact that when the crime is reported to have been committed at Koida, the Court at Bonai has jurisdiction and the F.I.R. was lodged at Koida Police Station. As per the provisions contained in Cr.P.C./BNSS, 2023 the matter is being tried at the appropriate Court.
5. It is further submitted by the learned counsel for the Petitioner that the petitioner faces trial for alleged offences committed under Section 498-A of the IPC. The complainant unfortunately passed away in Cancer. After that the petitioner has remarried and stays at Dhenkanal. The subsequent developments as narrated by the Petitioner cannot be a ground to transfer the trial to Dhenkanal.
6. At this stage the learned counsel for the Petitioner files memo of date seeking withdrawal of the Petition which stats thus:
“The learned counsel appearing on behalf of the petitioner submits that the petitioner does not want to press this application and wants to withdraw the same.
amit
In view of the same, the TRP(CRL) be disposed of as withdrawn.
Hence this memo”
The memo is taken on record. Scanned copy be updated.
7. Accordingly, the TRPCRL stands dismissed.
