ORDER

29.06.2026

02.

1. The instant writ petition in the nature of habeas corpus is taken out for a direction to the opposite parties, more particularly, opposite party Nos.1 to 3 to take appropriate steps to rescue the minor daughter of the petitioner.

2. On receipt of written instruction from Inspector-in-Charge, Basudevpur Police Station, Mr. Debashis Tripathy, learned Addl. Government Advocate submitted that on 27.06.2026, the victim has been rescued from the jurisdiction of Soro P.S. and her statement under Section 180 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short, ‘BNSS’) has been recorded by the woman Sub-Inspector of the concerned Police Station. Thereafter, the victim has been sent to CHC, Basudevpur for her medical examination, which was refused by the victim. Ultimately, the victim was sent to Swadhar Gruha, Bhadrak for her shelter temporarily and proper counselling.

3. In view of the above development, since the victim girl has already been rescued and is in safe custody of Swadhar Gruha, Bhadrak for her shelter, this Court does not feel it appropriate to keep the instant writ petition pending as it would sub-serve no fruitful purpose. Further, it is expected that the State would take all possible steps as provided in the statute against the accused, in the event it is found that the accused has committed the offence.

4. Accordingly, the WPCRL stands disposed of.
