ORDER

24.06.2026

01.

1. The instant writ petition is at the behest of the petitioners in the nature of Public Interest Litigation (PIL) raising a serious concern on construction of a Mandap at the plots of land recorded in the name of a Government School.

2. According to the petitioners, the said plots of land are meant for the students of the said Government school and any such construction which invites a public footfall for festivals and/or the ceremonies to be organized shall impact the standard of education and, therefore, the obligation of the Government under the Constitution to provide quality and seamless education to the students shall be compromised. The Record of Right (RoR) is produced to corroborate the stand that the said plots of land over which the attempt is made to construct the Mandap actually recorded in the name of the said Government school.

3. We invited the attention of Mr. Debashis Tripathy, learned Additional Government Advocate (AGA) appearing on behalf of the State-opposite parties obviously showing a serious concern where the land meant for the students of the said Government school whether the same can be utilized and/or used for the construction of a Mandap.

4. It is submitted by Mr. Tripathy, learned AGA on instruction that actually separate plot numbers measuring 3.25 Acres of land have been allotted to the said school and, in fact, the school is running therefrom. The initial allotment of the plot in favour of the said Government school was felt incompatible as it would not meet the basic need of the students and after the said allotment of the separate plots, Alienation Case No.10 of 2025 was initiated and ended with a direction concerning the regularization of the said land in favour of the School and Mass Education, Odisha. Since there was a growing demand of the villagers to construct a Mandap, a conscious decision was taken at the Government level to construct the same.

5. It is not a case as made out by the petitioners that the opposite party No.7 in fact, is constructing the Mandap for his own gain but it is the initiative of the Government to construct by engaging a contractor and the said Mandap belongs to the Government and not to any individual.

6. Since the said Government school has been allotted separate plots of land which are used and utilized for imparting education to the students and the said plots of land, which were initially allotted to the school but later on regularized in favour of the Government, we do not think that the construction of the Mandap has impacted the education of the students.

7. In view of the above, the writ petition is disposed of.
