ORDER
23.06.2026
01. (Through Hybrid Mode)
1. This CRLMP has been filed for a direction to add the offence under Section 74 of the BNS to the offences in which Aul PS Case No.221 of 2026 has been registered.
2. Mr. Aparesh Bhoi, learned counsel for the Petitioner submits that a bare perusal of the FIR would reveal that the offence under Section 74 of the BNS is made out against the accused persons but the case has been registered under Sections 126(2), 115(2), 296, 351(2) and 3(5) of the BNS.
3. As the investigation is in progress, this Court does not want to issue any direction which will interfere with the investigation.
4. But as it is the duty of the Inquiry Officer to conduct a fair and impartial investigation, the CRLMP is disposed of observing that if the investigation reveals that the offence under Section 74 of the BNS is made out against the accused persons, the said offence will be added to the offences, follow up action under the BNSS taken and final form submitted in accordance with law, based on such materials.
