ORDER
23.06.2026 Order No.
01. (Through hybrid mode)
1. This CRLMP has been filed directing the Opposite Party No.3 for proper investigation, arrest of the accused person and to submit charge sheet in connection with 1CC No. 23 of 2024 forward from the Court of the learned JMFC, Aul under Annexure-1.
2. Perused the ordersheet in 1CC No. 23 of 2024 which has been annexed as Annexure-1 to this petition.
3. Perusal of the same reveals that on 10.04.2024, learned JMFC, Aul had sent the original complaint petition to the IIC, Rajkanika Police Station for registration and investigation under Section 156
(3) of the Cr.P.C. with a direction to submit a report to the Court to the Court by 09.05.2024. The order dated 23.10.2025 reveals that on the said date, the case was posted awaiting report from the concerned Police Station but since report had not been received, the matter was adjourned to 16.01.2026 for awaiting report. Unfortunately, the learned counsel for the Petitioner has not annexed the subsequent orders which have been passed on 16.01.2026 or thereafter nor made any averments regarding developments following that date. But since as way back on 10.04.2024, learned JMFC, Aul has directed for registration of a case and sent the complaint to the IIC, Rajkanika Police Station for registration of the case and investigation, the IIC, Rajkanika Police Station is duty bound to carry out the said order and register the case.
4. This Court in the case of Registrar (Judicial), Orissa High Court, Cuttack vrs. Manoranjan Kumbhar, IIC, Bisra Police Station, Rourkela in CONTC No. 2824 of 2026 has already directed the Director General of Police, Odisha to issue suitable instructions / directions to a sub-ordinate officers to comply with the orders passed by the different Courts in the State of Odisha.

5. In view of the above discussion, although this Court is not the executing authority of the learned JMFC, but considering the fact that the IIC is not honouring or complying with the direction of the learned Magistrate resulting in delay in registration and investigation in the case, the CRLMP is disposed of directing the IIC, Rajkanika Police Station to register a case in compliance of order dated 10.04.2024 if not already registered and submit a report in this regard to the learned JMFC, Aul within a period of three weeks from today.
6. Urgent certified copy of this order be granted on proper application.
