ORDER

23.06.2026

Petitioner No.1 is the borrower whereas Petitioner No.2 is the guarantor against whom the coercive proceedings initiated have resulted into auctioning of the property, for their default in repayment of the loan. They were before this Court twice earlier; one in WP(C) No.26350 of 2017 which was followed by CONTC No.1802 of 2018, and another in WP(C) No.31620 of 2023. Some relief was accorded to them conditionally and those conditions having not been complied with, they could not draw milk from the orders since the lender-Bank stuck to the letter of the orders.

2. Now, learned counsel appearing for the Petitioners having given up the textual prayer, very firmly submits that justice would be done to his clients, if a direction is issued to the DRT to hear and dispose off their pending SA No.81 of 2024 expeditiously. He also seeks some reprieve till such disposal takes place.

3. Learned Panel Counsel appearing for the lender-Bank opposes the petition by filing counter affidavit. Since main prayer is not pressed into service, we need not undertake a deeper examination of the same counter, more particularly, when the prayer now made is innocuous and consistent with right to speedy justice recognized by the Apex Court in a catena of decisions.

In the above circumstances, the DRT is requested to hear and dispose off SA No.81 of 2024 on a war footing. Discretion lies in the DRT to consider request of the Petitioners for reprieve, if grounds do exist therefor.

Web copy of this order to be acted upon by all concerned.
