23.06.2026
03. The challenge by the borrower is to the coercive action of recovery of outstanding loan constituted under the provisions of SARFAESI Act, 2002. This Court at the admission stage had granted interim protection vide order dated 09.06.2026 in I.A. No.10950 of 2026, which reads as under:- “As an interim measure, it is directed that no coercive action shall be taken against the Petitioner till the next date, if he deposits the sum of Rs.25,00,000/-within a week as undertaken.”
2. The borrower was shown indulgence with the above that he would comply with the condition stipulated in the above interim order, but he failed.
3. In view of the above, the petition is liable to be rejected and accordingly it is.
Cost having been made easy.
