ORDER
22.06.2026
The challenge in this Petition is to the order of the Central Administrative Tribunal dated 07.05.2026, whereby Petitioner’s OA No.260/00202 of 2024 has been rejected. In the said OA, Petitioner had called in question his transfer order whereby he is sought to be shifted from Bhubaneswar to Bhopal.
2. Learned counsel for the Petitioner submits that the transfer order being contrary to law and the norms laid down by certain memoranda, the same ought to have been voided by the Tribunal. He also adds that his wife being employed in Calcutta presently on transfer, he will be satisfied if liberty is given to his client to make a representation seeking a spousal placement on normative basis.
Having heard learned counsel for the parties and having perused the petition papers, we decline indulgence in the matter, inasmuch as we do not find any legal or factual lacuna in the impugned order of the Tribunal. The Apex Court in B. Varadha Rao v. State of Karnataka; AIR 1986 SC 1955 has held that in transfer matters ordinarily the Writ
Court should not grant indulgence subject to all just exceptions into which argued case of the Petitioner does not fit.
In the above circumstances, Petition is disposed off reserving liberty to the Petitioner to make appropriate representation to the concerned authorities seeking redressal against the transfer order in question in accordance with law. Of course, such representation, if made, shall be considered by the concerned authorities only if the present transfer order is probate by the Petitioner by reporting for duty at transferred place, namely, Bhopal and not otherwise. All contentions of the parties as to the consideration of the representation are kept open. The concerned authority after considering the subject representation shall inform the result of consideration to the Petitioner forthwith.
No costs.
