01. (Through virtual mode)
1. This writ application has been filed challenging the ‘Kha’ notice dated 11.06.2026 issued by the Tahasildar, Dasarathpur in Encroachment Case No.70/2026-27 to show cause and not to evict the Petitioner as he has not encroached Government land as per demarcation report under Annexure-3, relating to Plot No.190, Khata No.460 of Kisama Rasta, stating that the Petitioner has not encroached the public road and he is residing on his own land.
2. Considering the submissions of the learned counsel, it is directed that the Tahasildar, Dasarathpur-Opposite Party No.3 shall not evict the petitioner from his recorded land. But if it is found that the Petitioner has encroached the public road, the Opposite Party No.3 is free to evict him.
3. It is open to the Petitioner to file his reply/ objection in Encroachment Case No.70/2026-27 if the same is still pending and to file appeal against the final order, if any passed in Encroachment Case No.70/2026-27.
4. With the above observation, the writ petition is disposed of.
