ORDER

22.05.2026

01.

1. The instant writ petition in the nature of Public Interest Litigation (PIL) has flagged a very important aspect of facilities and amenities to be provided to the citizenry of the country to live in a dignified manner and in a dignified way. On the advent of the human civilization and colonization embracing the community living, the importance and significance of sanitation system is necessary and cannot be compromised in any manner. The colonization and living together within the composed area must have all civic amenities, which includes sanitation system to be in place, apart from the other facilities for which the Government is under obligation to do so.

2. The villagers have been demanding for a proper drainage system to be put in place, so that the waste effluents are not accumulated and there is a proper mechanism to be adopted, so that it may not invite any casualty or severe diseases. The accumulation of foul water or a solid waste is a breeding ground of many insects which may cause deadly diseases, impacting the quality human life and it is inconceivable and improbable that the Government would not respond to such genuine grievance of the inhabitants of the locality.

3. The approach was made to a Competent Authority to construct a drainage system, which according to the petitioners, went in deaf ears. However, on a persistent request, the Block Development Officer BDO), Pipli, in the district of Puri has made an extensive enquiry into the matter and has suggested the construction of a drainage system.

4. We invited the attention of Mr. Debashis Tripathy, learned Additional Government Advocate (AGA) appearing on behalf of the opposite parties-State to disclose the stand of the Government in this regard and the steps having taken on the basis of such recommendation of the authority concerned.

5. It is fervently submitted on instruction that the necessity and the importance of a drainage system is always taken on priority by the Government and, in fact, steps are being taken for removal of the encroachment which impedes the construction of a drainage system at the proposed site. He further submits that the encroachment has been removed and construction of a drainage system is ensued and, virtually, 80% of the work has already been done but because of the paucity of fund and release of the fund from the Finance Department, the rest 20% work could not be ensured.

6. Since the Government has shown alacrity in redressing the grievance so raised by the inhabitants of the locality, including the petitioners, who are the public spirited persons, we, therefore, direct the Government to immediately complete the rest 20% work. Correspondingly, the direction is also passed upon the other authorities, who are in the helm of releasing the fund, to take immediate steps, so that the remaining work is completed within two months from the date of communication of this order.

7. With these observations and direction, the instant writ petition is disposed of.
