ORDER

14.05.2026 (Hybrid Mode)

04.

1. The petitioner before this Court is the wife in the marriage. She seeks transfer of C.P. No.302 of 2024 pending before the learned Judge, Family Court, Jajpur to the court of learned Judge, Family Court, Jharsuguda. To support the prayer for seeking transfer, the learned counsel for the petitioner refers to the cause title page of C.P. No.302 of 2024 pending before the learned Judge, Family Court, Jajpur particularly the address given therein that the petitioner-husband is presently residing at Vedanta Township, Qtr. No.NF-808 PO. Burkhamunda, PS.-Badmal, Dist.- Jharsuguda.

2. The CP has been filed by the husband in the marriage U/s.13(1)(i-a) of the Hindu Marriage Act, 1955 seeking dissolution of marriage solemnized between the parties on 08.03.2021 and grant of decree of divorce.

3. It is submitted that both the parties staying at Jharsuguda, the initiation of the proceeding at Jajpur at 378 KMs. away causes immense hardship to the opposite party-respondent before the learned Civil Court and also would not be convenient to the petitioner-husband.

4. The learned counsel for the opposite party Mr. Parija opposes the prayer for transfer stating several difficulties faced and apprehensions felt by the husband for which he has chosen to file the petition at a distant place at Jajpur.

5. Having heard learned counsel for the parties, this Court is of the considered view that the parties may have their reservations to prosecute the matter at Jajpur or at Jharsuguda but that can be at a place which can be termed to be neutral i.e. Sundargarh, which is about 33 KMs. away from Jharsuguda.

6. The learned counsel for the parties are also apprised that instead of keeping the matter stalled in the process they should cooperate in prosecuting the matter at Sundargarh.

7. Accordingly, it is directed that CP No.302 of 2024 pending before the learned Judge, Family Court, Jajpur shall be transferred to the learned Judge, Family Court, Sundargarh.

The parties are directed to appear before the learned Judge, Family Court, Sundargarh on 01.07.2026. On the said date, the learned counsel shall fix the further proceeding. The parties are also directed to cooperate in the expeditious disposal.

8. The petition is disposed of.

It is submitted by the learned counsel for the parties, if required they shall avail the facility of Information and Communication Technology (ICT)/digital facility in the proceeding before the learned Judge, Family Court, Jharsuguda.

It is directed that the parties to the litigation, if so advised, shall make application before the said Court for extending the facility of ICT such as virtual hearing, deposition etc. Upon making such application, learned court shall pass appropriate orders in accordance with law.
