ORDER

11.05.2026 (Hybrid Mode)

01.

1. The husband in the marriage is the petitioner before this Court. He raises a limited grievance to the extent that I.A. No.95 of 2025 filed by him in C.P. No.75 of 2024 pending before the learned Judge, Family Court, Cuttack should be taken up.

It is submitted by the learned Senior Advocate for the petitioner that the matter is posted to 15.05.2026.

2. Considering the limited nature of prayer, this Court is of the considered view that taking up of the said I.A. arising out of C.P. No.75 of 2024 which inter alia seeks visitation and contact rights with the children emanating from the application filed by the husband under Section 9 of the Hindu Marriage Act seeking restitution of conjugal rights, would not prejudice either of the parties to the C.P./I.A.

3. The learned Judge, Family Court shall do well to consider the I.A. filed by petitioner-husband seeking visitation and contact rights vis-à-vis his children, by hearing both the parties and shall pass appropriate order.

The petitioner herein shall produce certified copy of this order before the learned court to do the needful.

4. Accordingly, the writ petition is disposed of.

Issue urgent certified copy as per rules.
