ORDER

07.05.2026 (Hybrid Mode)

04.

1. The matter having been listed for orders is mentioned by the learned counsel for the appearing parties at the beginning of the day’s proceeding.

2. TRP(C) No.325 of 2025 has been filed by the wife in the marriage seeking transfer of CP No.174 of 2025 pending before the learned Judge, Family Court, Puri to the court of learned Judge, Family Court, Cuttack.

TRP(C) No.385 of 2025 has been filed by the wife in the marriage seeking transfer of CP No.357 of 2025 pending before the learned Judge, Family Court, Puri to the court of learned Judge, Family Court, Cuttack.

3. Both the transfer petitions have been filed by the wife in the marriage, the husband being the opposite party in both the cases, were referred for mediation by order dated 09.01.2026 by the coordinate Bench. Mediation has become successful.

4. The report dated 06.04.2026 of the learned Mediator is on record. The report indicates thus:

“I persuaded and generated various points for settlement of their disputes by adopting ADR mechanisms. During the course of mediation both the parties agreed to settle the dispute mutually as per the joint affidavit they have filed on the last date and that may be taken into part and parcel this order. Original copy of the joint affidavit is hereby annexed with this order.

That, both the parties are agreed to abide the clause of the joint affidavit and as per the said affidavit the opposite party Sri Sanjeeb Kumar Sen today handed over a sum of Rs.75,00,000/- (Rupees Seventy five thousand) vide Demand Draft bearing No.159307 of dated 06.04.2026. A copy of the said DD along with a copy of the receipt is hereby annexed with this order.

That, the parties at their free will and sweet consent have entered into this settlement without being influenced in any manner and further it is agreed by both the parties to this settlement that neither party will raise any kind of dispute in respect of this case in future.

Hence, “The Mediation became Successful”.

5. Even though it has been mentioned at paragraph- 4 sub-para 3 of joint affidavit dated 30.03.2026 that Rs.75,000/- is to be paid before the learned Mediator in the mediation proceeding at the Orissa High Court Mediation Centre in the form of demand draft, it is inadvertently mentioned in the mediation report as Rs.75,00,000/- in figures. However, the amount in words is correctly mentioned as Rupees Seventy five thousand and also the demand draft is amounting to Rs.75,000/-. So it should be read as Rs.75,000/-.

6. Memo dated 23.04.2026 has been filed in TRP(C) No.325 of 2025, which states thus:

“The TRP(C) matter kindly permitted to withdraw.”(sic)

Memo dated 04.05.2026 has been filed by the learned counsel for the petitioner, which states thus:

“The TRPC matter kindly permitted to withdraw. As the mediation report have submitted in the Court.”(sic)

7. In view of the above, both the petitions i.e. TRP(C) No.325 of 2025 and TRP(C) No.385 of 2025 stand disposed of.

8. Registry is directed to attach a copy of this order in the record of TRP(C) No.385 of 2025.

9. Copy of this order along with the report of mediation shall be forwarded by the Registry to the court of learned Judge, Family Court, Puri to be kept in the records of CP No. 174 of 2025 and CP No.357 of 2025.
