1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Marsaghai PS Case No.323 of 2025 corresponding to GR Case No.2100 of 2025 pending in the file of learned SDJM, Kendrapara for commission of offences punishable U/Ss.296/309(6) of BNS, on the main allegation of committing robbery from the informant and taking away cash of Rs.1,28,000/- and six number of goats, along with co-accused persons.

3. Heard, Mr. Deepak Kumar Sahoo, learned counsel for the petitioner and Mr. T.K. Acharya, learned Additional Public Prosecutor in the matter and perused the record.

4. Admittedly, the FIR has been registered against one Tubu and others, but the petitioner has been implicated in this case subsequently on the statement of one witness Butu Behera and the petitioner is in custody since 20.10.2025, however, no criminal antecedent of similar nature or any property offence has been reported against the petitioner. In such view of the matter and after having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-a-vis the accusation sought to be brought against him and regard being had to the inherent right of the accused to be presumed innocent until proven guilty at the trial and keeping in view the non- commencement of trial and taking into consideration the other circumstance on record in entirety including grant of bail to co-accused Jitu @ Jitendra Behera in BLAPL No. 11800 of 2025, this Court without expressing any view on merit admits the petitioner to bail.

5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000 /- (Rupees Twenty Five Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following conditions:-

(i) the petitioner shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10

A.M. to 12 Noon for six(06) months from the actual date of his release from the custody.

The I.I.C. of Jurisdictional Police Station shall not detain the petitioner unnecessarily after recording his attendance beyond the time as stipulated.

6. Accordingly, the BLAPL stands disposed of.
