1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. Mr. Tara Prasad Mohapatra, learned counsel for the petitioners by filing a memo, which is taken on record, prays to not press the bail application of petitioner No.1-Rama Chandra Dalai @ Rama Chandra Dalei. Accordingly, the bail application of the petitioner No.1-Rama Chandra Dalai @ Rama Chandra Dalei stands disposed of as not pressed and the present bail application is only confined to petitioner Nos.2 & 3-Purna Chandra Dalai @ Purna Chandra Dalei and Krushna Chandra Dalai @ Krushna Chandra Dalei.

3. This is a bail application U/S.483 of the BNSS by the petitioner Nos.2 & 3-Purna Chandra Dalai @ Purna Chandra Dalei and Krushna Chandra Dalai @ Krushna Chandra Dalei for grant of bail in connection with Krushnaprasad PS Case No.154 of 2025 arising out of GR Case No.550 of 2025 pending in the Court of learned

JMFC-1, Puri, being charge-sheeted for commission of offences punishable U/Ss.85/351(2)/108/3(5) of BNS r/w Section 4 of DP Act, on the main allegation of abetting commission of suicide of the deceased by subjecting her to torture and cruelty for demand of dowry, along with co-accused persons in furtherance of their common intention.

4. In the course of hearing, Mr. Tara Prasad Mohapatra, learned counsel for the petitioner Nos.2 & 3- Purna Chandra Dalai @ Purna Chandra Dalei and Krushna Chandra Dalai @ Krushna Chandra Dalei submits that the petitioners are the father-in-law and brother-in-law of the deceased and, therefore, the petitioners may kindly be granted bail.

4.1. In opposing the prayer for bail, Mr. T.K. Acharya, learned Additional Public Prosecutor, however, submits that although charge-sheet was submitted for Section 108 of BNS, but the Court has taken cognizance of offence U/S.103(1) of BNS and, therefore, the petitioners being liable for committing murder of the deceased, should not be granted bail. Accordingly, Mr. Acharya prays to reject the bail application of the petitioners.

5. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners-Purna Chandra Dalai @ Purna Chandra Dalei and Krushna Chandra Dalai @ Krushna Chandra Dalei vis-à-vis the accusations sought to be brought against them and regard being had to the pre trial detention of the petitioners in custody since 14.07.2025 and 12.09.25025 with submission of charge-sheet in the meantime and keeping in view the status of the petitioners as the father-in-law and brother-in-law of the deceased and the main allegation being primarily directed against co- accused husband and taking into account the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty, which is unlikely to commence in near future, this Court without expressing any view on merits, admits the petitioners-Purna Chandra Dalai @ Purna Chandra Dalei and Krushna Chandra Dalai @ Krushna Chandra Dalei to bail.

6. Hence, the bail application of the petitioners- Purna Chandra Dalai @ Purna Chandra Dalei and Krushna Chandra Dalai @ Krushna Chandra Dalei stands allowed and the petitioners are allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) each with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.

The present order shall not constitute as a precedent for grant of bail to the co-accused-husband.

7. Accordingly, the BLAPL stands disposed of.

8. Issue urgent certified copy of the order as per Rules.
