ORDER

24.12.2025

01.

1. Since both the ABLAPLs relate to the same FIR, on the consent of the parties, they are taken up together and disposed of by this common order.

2. Heard learned counsel for the Petitioners and learned counsel for the State.

3. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.615 of 2025 pending on the file of learned J.M.F.C.-II, Cuttack arising out of Barang P.S. Case No.223 of 2025 for commission of offences punishable under Sections 115(2)/ 109(1)/ 126(2)/ 296/ 3(5)/ 304(2)/ 305(b) of BNS.

4. It is submitted by the learned counsel that the co-accused have since been released on bail by the learned Sessions Judge, Cuttack vide order dated 01.05.2025 in BLAPL No.503 of 2025 and while releasing them on bail, the learned Court has taken note that the injury suffered are simple and the matter has been amicably settled inter se between the parties.

5. For convenience of reference, the relevant extract of the order is culled out hereunder:-

“Except offence 109(1)/304(2)/305(b) of BNS, other offences are bailable in nature. So far as offence U/sec. 109 of BNS is concerned, the injury report submitted by the I.O reveals that the victim Kasinath and one Ashok Pothal have sustained injury on their body are simple in nature. It is found that this case has arisen out of a land dispute in between both the parties and in the meantime the matter has been amicably settled in between them in presence of village gentries as submitted by the learned defence counsel”

6. Referring to the same, it is submitted by the learned counsel for the Petitioners that the Petitioners may be protected by pre-arrest bail.

7. Per contra, learned counsel for the State opposes the prayer for pre-arrest bail, inter alia, on the ground that the Petitioners are not entitled to the exceptional remedy of pre-arrest bail.

8. It is also submitted at the Bar that the Petitioners do not have any criminal antecedents of similar nature.

9. Taking into account the nature of allegations, the release of the co-accused and the observations of the learned Sessions Judge quoted hereinabove, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

10. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.

11. Accordingly, the ABLAPLs stand disposed of.
