4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is 19 years old and has just emerged as an adult and it is admitted that the deceased was in relationship with him, which was objected by the parents, which led her to commit suicide, as her parents pressurized the deceased not to be in company of the petitioner. Learned counsel submitted that the petitioner himself being immature, he could not understand that what would be the consequence of such relationship. On these grounds, the petitioner seeks to be released on pre-arrest bail.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail and submitted that sufficient materials have come against the petitioner in course of the investigation. CDR also supports that the petitioner was in regular communication with the deceased and as such, the complicity of the petitioner in the allege offence cannot be denied.
6. Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the FIR and the materials which were surfaced in course of investigation, I find that there is direct allegation against the petitioner and finally due to alleged act of the petitioner and Patna High Court CR. MISC. No.48141 of 2026(3) dt.21-08-2026
other co-accused persons, the minor girl was found dead. I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the present bail application stands dismissed.
