20-08-2026 Heard Mr. Ranjeet Kumar, learned counsel for the petitioner, Mr. Hemant Ray, learned counsel representing the informant as also Mr. Jitendra Kumar Singh, learned APP.

2. The petitioner is apprehending his arrest in connection with Kartaha P.S. Case No. 144 of 2025 for the offence under 64, 318(4), 351(2) and 3(5) of the BNS and Section 4/6 of the POCSO Act lodged on 26.11.2025 by the informant, XYZ.

3. As per the prosecution story, the minor girl alleged that on 17.08.2025, when she was returning home alongwith her mother, the accused persons took her to a deserted place and behind the bushes, raped her. They, later, left the said place. The further allegation is of cheating against the accused persons. This led to the FIR.

4. Earlier, the Coordinate Bench had called for the case diary and the statement of the victim girl which are available on Patna High Court CR. MISC. No.35582 of 2026(4) dt.20-08-2026

record.

5. Though learned counsel for the petitioner submits that the allegation of rape is against the other accused persons and so far as this petitioner is concerned, the allegation is that he exhorted them to rape the girl, learned counsel representing the informant has taken this Court to the statement made by the girl to show that he played an active role in the said rape and chose neither to help her nor to force the accused to leave the place. The submission is that he cannot be allowed to escape from the said allegation. The last submission is that the other two accused, namely, Abhishek Kumar and Raushan Kumar, have also been denied bail and are in judicial custody.

6. Learned APP, Mr. Jitendra Kumar Singh also echoes the same view.

7. Considering the aforesaid facts, the role that has been played by the petitioner and the girl is minor, no relief can be extended to him.

8. The anticipatory bail application stands rejected.
