ORAL ORDER
19-08-2026 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends arrest in connection with Ramgarhwa P.S. Case No. 72 of 2026 lodged on 09.02.2026, for the offence punishable under Sections 191(2), 191(3), 190, 195, 222, 285, 109(1), 324(4), 132 and 121(1) of the BNS, 2023.
3. As per the prosecution case, the FIR has been lodged against twenty-three named accused persons, including the present petitioner, and 100–125 unknown persons, alleging that they obstructed the State Highway, abused the local residents, caused obstruction to small vehicles, and created hindrance in the smooth functioning of traffic.
Patna High Court CR. MISC. No.55922 of 2026(2) dt.19-08-2026
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the allegations in the FIR are in two parts. The first part of the occurrence allegedly took place at Machhali Hatta (fish market), where the name of the petitioner does not figure. It is only in the subsequent allegation relating to the blocking of the road by unknown persons that the petitioner has been implicated. Learned counsel further submits that the petitioner was merely a passer-by and has been falsely and unnecessarily implicated in the present case. He submits that the petitioner has clean criminal antecedents and is ready and willing to abide by any condition that may be imposed by this Court.
5. Learned APP for the State opposes the prayer for bail; however, he fairly submits that the petitioner has been made accused for the second part of the allegation.
6. As such, in the facts and circumstances of the present case, and upon considering that the allegations made in the FIR are general and omnibus in nature against a large number of persons, let the above-named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Patna High Court CR. MISC. No.55922 of 2026(2) dt.19-08-2026
Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari, in connection with Ramgarhwa P.S. Case No. 72 of 2026, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
