ORAL ORDER

19-08-2026 Heard the parties.

2. The petitioner seeks regular bail in connection with Hasanpur P. S. Case No. 107 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109, 103(1) & 3(5) of the BNS.

3. The main submissions advanced by learned counsel for the petitioner are that the FIR has been registered against 17 accused persons, including the petitioner and specific allegations of assault have been levelled against four accused persons named in the FIR. However, no specific allegation has been levelled against the petitioner and his name merely finds place along with the other accused persons, without disclosing any specific role attributed to him in the commission of the alleged occurrence. It is further submitted that the petitioner has no criminal antecedents and has been languishing in jail since 08.05.2026 and investigation has been Patna High Court CR. MISC. No.58921 of 2026(2) dt.19-08-2026

completed against him. It is further submitted that both the parties are agnates and a land dispute running in between them is said to be the genesis of the occurrence.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the aforesaid submissions and mainly taking note of the fact that the FIR has been registered against 17 accused persons, including the petitioner, and in the entire FIR, no specific role of the petitioner in the commission of the alleged murder has been revealed, whereas specific roles have been attributed to four co-accused persons in the killing of the deceased, coupled with the petitioner's fair and clean antecedents, his period of custody, and the completion of the investigation against him, this Court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Hasanpur P. S. Case No. 107 of 2026 on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. Rajiv/- (Shailendra Singh, J) U T
