4. Learned Advocate for the petitioner referring the FIR primarily contended that even if the allegation is taken to be true, the injuries sustained to the informant’s son is specifically attributed to co-accused Ashik Maharaj. On account of previous animosity and the village rivalry, the name of the petitioner has been implicated in this case. The petitioner is carrying fair antecedent and he undertakes that he will fully cooperate in the proceeding of the court. Learned Advocate for the petitioner further argued that one of the co-accused person has been extended the privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 11141 of 2026 vide order dated 25.02.2026, copy of which is marked as Annexure-3 to the bail application.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the nature of the accusation, coupled with the simple nature of injuries, besides the fair antecedent of the petitioner and also Patna High Court CR. MISC. No.58356 of 2026(2) dt.19-08-2026

the fact that co-accused person facing identical allegation has been extended the privilege of anticipatory bail, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri, Sitamarhi in connection with Bokhra P.S. Case No. 196 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
