19-08-2026 Heard learned senior counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Wazirganj P. S. Case No. 498 of 2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 126, 115(2), 117(1), 118(1), 109, 103(1), 352, 351(2) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, this petitioner along with other accused persons came and forcibly started ploughing the field of informant from tractor. Upon objection, all the accused persons assaulted informant and his family members by means of lathi, danda, gadasa and iron rod as a result of which uncle of the informant sustained injuries and died during the Patna High Court CR. treatment.

4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus. As per F.I.R., 11 named and some unknown persons are alleged to have assaulted the deceased but as per post-mortem report, only two injuries were found on his body. There is no allegation of any specific overt act against the petitioner. Petitioner claims clean antecedent and he is in custody since 23.11.2025.

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that there is specific accusation that this petitioner repeatedly assaulted the deceased with iron rod and he is one of the assailants of the deceased.

6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioner is rejected.

7. However, since petitioner is in custody since 23.11.2025, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
