ORAL ORDER

19-08-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in connection with Koilwar P.S. Case no.93 of 2026 registered under sections 305(b) and 3(5) of BNS, 2023.

3. Allegation in the F.I.R is that unknown miscreants committed theft of Rs.10,000/- and a mobile phone of the driver the truck.

4. Learned counsel for the petitioner submits that present case has been lodged by S.I. of Police, based upon secret informant that theft of mobile phone and some money has been taken from an empty truck and the driver of the truck gave a very vague description of miscreants whereafter name of one of the petitioner transpires as his one photograph was shown which Patna High Court CR. MISC. No.57691 of 2026(2) dt.19-08-2026

was given by the police to the truck driver which claimed to be identified him. It is further submitted that there is no explanation as to why the truck driver himself did not lodge the present case. Further, submission is that petitioner is a young student of B.A. 4th year and undertakes to co-operate in case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State on the ground that petitioner has one criminal antecedent. However, in response it has been submitted that the said case is under the excise Act and petitioner is on bail in the said case.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the vague nature of allegation based upon photographic identification, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Koilwar P.S. Case no.93 of 2026 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Patna High Court CR. MISC. No.57691 of 2026(2) dt.19-08-2026

Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023, subject to the following conditions:- (I) One of the bailors of the petitioner shall be the family member/close relative of the petitioner. (II) He shall co-operate in the investigation/trial and would make himself available before the Investigating Officer as and when required.
