ORAL ORDER
19-08-2026 Heard the learned counsel for the petitioner and the learned counsel appearing for the State.
2. The present application has been filed seeking cancellation of the bail granted to Opposite Party No. 2, who has been arrayed as an accused in Madanpur P.S. Case No. 218 of 2026, corresponding to POCSO G.R. No. 77 of 2026, for the offences punishable under Sections 126(2), 74 and 75 of the Bharatiya Nyaya Sanhita, 2023, Sections 8/12 of the POCSO Act, 2012, and Sections 3(1)(r), 3(1)(w) and 3(2)(va) of the SC/ST Act.
3. This Court has carefully perused the impugned order dated 08.06.2026 passed by the learned A.D.J.-VI-cum- Patna High Court CR. MISC. No.55292 of 2026(2) dt.19-08-2026
Special Exclusive Judge (POCSO), Aurangabad, in POCSO G.R. No. 77 of 2026, whereby Opposite Party No. 2 has been enlarged on bail. On a careful consideration of the impugned order and the materials available on record, this Court finds that the learned Court below has considered the relevant facts and circumstances of the case and has passed a reasoned and well- considered order while granting the privilege of bail to Opposite Party No. 2.
4. In the present case, no supervening circumstance has been brought on record by the petitioner, nor is there any material before this Court to demonstrate that Opposite Party No. 2 has misused the privilege of bail or violated any of the conditions imposed by the learned Court below. Having regard to the facts and circumstances of the case and upon careful perusal of the impugned order, this Court finds that the same does not suffer from any illegality, perversity or infirmity warranting interference in exercise of the jurisdiction of this Court. Accordingly, this Court finds that no sufficient ground has been made out for cancellation of the bail granted to Opposite Party No. 2.
6. Accordingly, the present application for cancellation of bail stands dismissed.
Patna High Court CR. MISC. No.55292 of 2026(2) dt.19-08-2026
7. It is made clear that the observations made hereinabove are confined to the adjudication of the present application for cancellation of bail and shall not prejudice the merits of the case at the stage of trial.
