1. Heard learned counsel for the petitioner and learned APP for the State.

Samsuddin and Iltaf Ansari of assaulting the informant’s husband by means of sword on head and subsequently an allegation has been made on this petitioner also of having assaulted him on his leg by means of spade and also of assaulting the daughter of the informant. However, discussion of injuries in the bail rejection order indicates that injuries suffered by them is simple in nature and the grievous injury sustained by the informant is on nasal bone which cannot be attributed to this petitioner. Further, co-accused Md. Samsuddin has also been granted anticipatory bail by a co-ordinate Bench of this Court vide order date 17.08.2026 passed in Cr. Misc. No.57921 of 2026. 5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the fact that act of assault had taken place between own brothers and the injury attributable to this petitioner has not resulted in any grievous injury, it is directed that the petitioner above named, having no criminal antecedent in the event of his arrest or surrender before Patna High Court CR.
