ORAL ORDER

19-08-2026 Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 790 of 2026 registered for the offence under Sections 25(1-B)a, 25, 26 and 35 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the petitioner, Mantu Kumar, was apprehended along with a motorcycle and upon search of his mobile phone, a photograph of a country-made pistol was allegedly found in its gallery. It is further alleged that the petitioner disclosed the name of co-accused Ranjan Kumar as his associate in the sale and purchase of country-made pistols. Thereafter, on the basis of the said disclosure, the police searched the petitioner's house from where one country-made pistol, five live cartridges, and 36 liters of illicit foreign-made Patna High Court CR. MISC. No.24320 of 2026(4) dt.19-08-2026

liquor were recovered.

4. The petitioner is in custody since 29.12.2025. It is submitted that by suppressing the fact regarding the pendency of the present bail application before this Court, the petitioner had obtained bail from the learned court below which has now been cancelled and the petitioner has surrendered and is presently in custody.

5. In these circumstances, considering the nature and the gravity of the offence, the criminal antecedent and the character of the petitioner, this Court is not inclined to grant regular bail to the petitioner.

6. Accordingly, this application for regular bail stands dismissed.

7. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
