ORAL ORDER

19-08-2026 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners are apprehending arrest in connection with Paliganj P.S. Case No. 201 of 2026, dated 19.04.2026, lodged under Sections 126(2), 127(2), 115(2), 109(1), 329(4) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as “BNS, 2023”).

3. As per the prosecution, an FIR has been lodged against five named accused persons, including the present petitioners, with an allegation that they all assaulted the Patna High Court CR. MISC. No.56106 of 2026(2) dt.19-08-2026

informant and his family members with lathi and danda, due to which injuries were caused and bleeding started. Subsequently, four stitches were made on the finger of the informant, and three stitches were made on the head and finger of two persons.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that they are adjacent neighbours and there were very good relations between them. Counsel further submits that on the date and at the place of occurrence, they were playing cards, and during the course of playing cards, a heated discussion started, which resulted in scuffling and injuries being caused to both sides. It is due to this reason cases have been lodged by both the informant as well as the petitioners. Counsel also submits that the criminal antecedents of the petitioners are clean and he is ready to fulfil all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that the cause of the dispute was playing cards and there is a case and counter-case between the parties.

6. Considering the facts and circumstances of the present case, let the above-named petitioners be released on Patna High Court CR. MISC. No.56106 of 2026(2) dt.19-08-2026

anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Sub-Divisional Judicial Magistrate, Danapur, District-Patna, in connection with Paliganj P.S. Case No. 201 of 2026, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
