ORAL ORDER

19-08-2026 Heard the learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Pothia P.S. Case No.234 of 2026, F.I.R dated 12.06.2026 registered for the offences punishable under Sections 79 and 108 of the Bharatiya Nyaya Sanhita, 2023.

3. According to prosecution case, the informant alleged that his daughter, who was a student of the accused, had been mentally disturbed for some time. On being asked, she disclosed that the accused, who was her teacher, had misbehaved with her and other students and had threatened to fail her in the examination. According to the informant, due to the accused’s conduct, his daughter remained under mental stress and, on 10.06.2026, committed suicide. The informant Patna High Court CR. MISC. No.57777 of 2026(2) dt.19-08-2026

informed the police, who arrived at the spot and conducted the post-mortem examination. The informant expressed his firm belief that his daughter had committed suicide due to the accused’s behaviour.

4. Learned counsel for the petitioner submits that although the alleged occurrence took place on 10.06.2026, the FIR was lodged on 12.06.2026, after a delay of two days, which casts serious doubt upon the prosecution case. It has next been submitted that the petitioner has been implicated merely on the basis of suspicion, without there being any positive or connecting evidence to establish his participation in the alleged occurrence. It has lastly been submitted that the deceased had committed suicide due to torture and harassment allegedly meted out by the family members of the informant, and in order to save themselves, the petitioner has been falsely implicated in the present case without any specific allegation against him.

5. Learned APP for the State opposes the prayer for anticipatory bail application.

6. Considering the aforesaid facts and circumstances that the deceased is said to have committed suicide on account of the alleged acts of misbehavior, mental torture, and teasing by the petitioner and from the impugned order, it appears that, Patna High Court CR. MISC. No.57777 of 2026(2) dt.19-08-2026

during the course of investigation, allegations of torturing the deceased in the presence of other students, as well as privately teasing her and engaging in obscene activities, have surfaced on record and on finding the allegations to be of a serious nature, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner.

7. Accordingly, the anticipatory bail application of the petitioner is hereby rejected.
