ORAL ORDER

19-08-2026 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner apprehends arrest in connection with Runnisaidpur P.S. Case No. 92 of 2026 lodged on 08.03.2026, for the offence punishable under Sections 115(2), 118, 109, 351(3), 352, 3(5) & 303(2) of the BNS, 2023, pending in the court of Addl. C.J.M.-VI, Sitamarhi.

3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner and some unknown persons. It has been alleged that the petitioner took out pistol from his waist and attacked on the informant’s right eye due to which he fell down. Thereafter, other accused Patna High Court CR. MISC. persons also assaulted the informant and his friend and one of the accused persons snatched Rs. 1,10,000/- from the informant and fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner has been falsely implicated in this case and the informant has inimical terms with the petitioner and only due to this reason, the present case has been lodged against the petitioner. Counsel further submits that the criminal antecedent of the petitioner is not clean as there are 12 cases pending against him and in all the cases, he is on bail.

5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner and submits that criminal antecedent of the petitioner is not clean as there are 12 cases pending against him and this aspect must be taken into consideration.

6. As such, in the present facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.

7. However, liberty is granted to the petitioner that if he surrenders before the concerned Trial Court within a period Patna High Court CR. MISC. No.56477 of 2026(2) dt.19-08-2026

of four weeks from today then in that case, the Trial Court is directed to pass order on his surrender-cum-bail application on the same day absolutely and strictly according to the law, without being prejudiced by the fact that the anticipatory bail application of the petitioner has been rejected by this Court.
