ORAL ORDER

19-08-2026 Heard Mr. Ravindra Kumar, learned Advocate for the petitioners and Mr. Satyendra Narayan Singh, learned APP for the State.

2. The petitioners apprehend their arrest in connection with Ara Nawada P.S. Case No.565 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352 & 3(5) of the BNS.

3. Allegedly, on the date and time of occurrence while the informant was sitting at the doorstep of his brother, in the meanwhile, the petitioners along with other accused persons came there and the petitioner No.1 wiped out his pistol and fired Patna High Court CR. MISC. No.58738 of 2026(2) dt.19-08-2026

on the informant, due to which he sustained a bullet injury on his cheek. There is a further allegation against the other accused persons of causing assault over the informant and others leading to injuries.

4. Learned Advocate for the petitioners submitted that the instant case is nothing but a counterblast to Ara Nawada P.S. Case No.564 of 2024, which is admittedly on earlier point of time. Moreover the entire prosecution case falls to the ground on mere perusal of the injury report, which suggests that besides the injuries have been reported to be simple in nature, it has not been disclosed that it has caused by bullet. He further submits that the reason behind the false implication is prior animosity, which resulted into various cases and counter cases between the parties.

5. On the other hand, learned Advocate for the State drew the attention of this Court to paragraph No.3 of the bail application and submits that petitioner No.1 carries 14 criminal antecedent, whereas petitioner No.2 is involved in 6 criminal cases.

6. Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the active participation of the petitioners, besides a list of Patna High Court CR. MISC. No.58738 of 2026(2) dt.19-08-2026

huge criminal antecedent, this Court is not acceded to the prayer for anticipatory bail of the petitioners.

7. Accordingly, the same stands rejected.
