As per the allegation, when the informant and his nephew, Raja Kumar, had gone to the local Court, after some time, seven unknown persons intercepted them and started abusing them on the pretext of their having allegedly behaved indecently with some girls. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in the present case and the QR code on which the money was sent does not belong to the petitioner rather the same belongs to one Rita Devi and the petitioner has got no concern with the said Rita Devi. It has further been submitted that name of this petitioner has transpired in this case only on the basis of confessional statement of the co-accused Sintu Kumar, made before the police, while in police custody, which has got no evidentiary value in the eye of law. It has further been submitted that no test identification parade of the petitioner has been held and nothing has been recovered from his possession. Lastly, it has been submitted that petitioner is in judicial custody since 15.12.2025 and chargesheet has been filed in this case without holding any test identification parade and the only material against the petitioner as of now, is the confessional statement of the co- accused, Sintu Kumar.
