ORAL ORDER

19-08-2026 Learned counsel for the petitioner and the learned APP for the State are present.

2. The petitioner seeks regular bail in connection with Sessions Trial No. 710 of 2024 arising out of Mehsi P.S. Case No. 344 of 2018, registered for the offences under Sections 323, 324, 447, 307, 504, 34 of IPC.

3. The prosecution case, in brief, is that, the petitioner who happens to be a woman, surrendered before the court below on 15.05.2026 with a prayer for bail. Suddenly, the petitioner felt abdominal pain and went away outside the court without information and because of this later on, a separate case was registered against her and she was taken into custody and still in judicial custody since 13.07.2026.

4. The learned counsel for the petitioner submits that Patna High Court CR. MISC. No. 59320 of 2026(2) dt.19-08-2026

although the petitioner should have informed the court below regarding her difficulty, she left the place without information and hence, she was taken into custody.

5. The learned APP for the State vehemently opposes the prayer for regular bail to the petitioner.

6. Having heard the parties and taking into consideration that earlier the anticipatory bail of the petitioner was allowed by a co-ordinate bench of this court on 13.09.2023 passed in Cr. Misc. No. 57980 of 2023, I am inclined to grant the petitioner benefit of regular bail. Let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of Court below/concerned Court in connection with Sessions Trial No. 710 of 2024 arising out of Mehsi P.S. Case No. 344 of 2018, registered for the offences under Sections 323, 324, 447, 307, 504, 34 of IPC, subject to the following conditions: (I) One of the bailors shall be the petitioner’s own or close family member. (II) The petitioner shall co-operate in the process of trial.

Patna High Court CR. MISC. No. 59320 of 2026(2) dt.19-08-2026

(III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial. (IV) The Petitioner shall not commit an offence of a similar nature in future. In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
