ORAL ORDER
19-08-2026 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner is apprehending arrest in connection with Turkaulia P.S. Case No. 231 of 2026 / G.R. Case No. 2629 of 2026, dated 30.04.2026, lodged under Sections 318(4), 308(4), 329(4), 316(2), 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as “BNS, 2023”).
3. As per the prosecution, an FIR has been lodged against three named and unknown accused persons, including the present petitioner, with an allegation that the informant and one of the co-accused are adjacent neighbours and there is an agreement between them for the sale and purchase of land. It has been alleged that the informant had given an advance for the purchase of the land, but the accused is neither returning the money nor selling the land. It has been further alleged against the petitioner that on 17.03.2026, the petitioner, being the son- in-law of one of the accused, went in his Jeep (Thar), put a pistol to the informant’s head, and threatened him to forget about the money, otherwise he would be killed. A threat was also made that a false case under cyber crime would be filed against the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the criminal antecedent of the petitioner is clean. Counsel further submits that, in the impugned order, one criminal antecedent of the petitioner has been shown, but during investigation, his name has been dropped. Counsel further submits that the dispute regarding the land or money is between the informant and the father-in-law of the petitioner, and the petitioner has nothing to do with the business transactions between his father-in-law and the informant. Counsel further submits that, as per his knowledge and information, the informant is a money lender who had provided a loan to his father-in-law, and due to the said transaction dispute going on between them, the petitioner has nothing to do with the same.
5. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that, as per the FIR, the real dispute is between the petitioner’s father-in-law and the informant.
6. Considering the facts and circumstances of the present case, let the above-named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M.F.C., Sadar, Motihari, East Champaran, in connection with Turkaulia P.S. Case No. 231 of 2026 / G.R. Case No. 2629 of 2026, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023 with other following conditions:-
(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;
(ii) the Trial Court shall verify the criminal antecedent of the petitioner, and in case it is found at any stage that the petitioner has concealed his criminal antecedent, the
Trial Court shall take steps for cancellation of the petitioner’s bail bond. However, the acceptance of the bail bond in terms of the above- mentioned order shall not be delayed for the purpose of or in the name of verification.
