ORAL ORDER
18-08-2026
1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on 26.02.2026 at 07:00 PM he was coming back home by a motorcycle when petitioner dashed him by his tractor near Ashok School, thus he fell behind a tree, further petitioner again tried to crush him with the tractor, but was saved as he had fallen behind a tree, further Mantu was also sitting on the tractor and thus he could not see the registration number of the tractor, Patna High Court CR. MISC. No.53858 of 2026(2) dt.18-08-2026
further his knee of right leg got damaged and was admitted in a hospital.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that it gives an impression that while informant was coming back home on his motorcycle he was intentionally dashed by a tractor being driven by the petitioner, but then it is submitted that petitioner is own cousin brother of the informant as father of informant and father of petitioner are own brothers, it is also submitted that Mahnar PS Case No. 105 of 2026 has been instituted from the side of the petitioner and a Title Suit No. 982 of 2019 in between the parties is pending adjudication, it is next submitted that no doubt the injury suffered by the injured has been opined to be grievous, but since the informant has not disclosed his relationship with the petitioner rather has given an impression that he was dashed by a tractor and he could not see the registration number of the tractor which amply demonstrates that informant falsely implicated the petitioner as informant, being own cousin brother of the petitioner, was well-aware of the registration number of the tractor, but for ulterior reason, the Patna High Court CR. MISC. No.53858 of 2026(2) dt.18-08-2026
same was not disclosed as the correct facts would have come to the fore that tractor was not even present at the place of occurrence, it is thus submitted that occurrence took place in some other manner and the petitioner came to be implicated.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahnar P.S. Case No. 85 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Thus, this application stands allowed.
