ORAL ORDER

18-08-2026

1. Heard learned counsel for the appellants and learned Spl. P.P. for the State, Sri Sadanand Paswan.

2. Learned Spl. PP, at the outset, submits that from perusal of the order impugned, it would manifest that appellants had filed surrender-cum-bail application bearing Case No. 1488 of 2025, but then the same was withdrawn.

3. At this stage, learned counsel for the appellants seeks permission to withdraw the appeal with liberty to the appellants to surrender and seek regular bail.

Patna High Court CR. APP (SJ) No.4834 of 2025(4) dt.18-08-2026

4. Permission is accorded.

5. Accordingly, the appeal is dismissed as withdrawn with the aforesaid liberty.

6. It is made clear that if the appellants surrender and seek regular bail, in that event the learned district court shall consider the case on its own merits without being prejudiced by the fact that appellants before this Court withdrew the appeal.
