ORAL ORDER

17-08-2026 Heard Mr. Yugal Kishor, learned counsel for the petitioner and Mr. Ramadhar Singh representing the State.

2. The present petition has been preferred for the following relief(s): “for issuance of writ in the nature of mandamus or an appropriate writ for commanding and directing the respondents to pay the compensation amount to the petitioner for acquisition of their land which has acquired by respondents for construction of state Highway-65 (Purnea-Harnaha- chandpur marg mile-Rupauli-Tikkapatti Road) in year 1976-77 of petitioner Thana No. 281/2 bearing Khata No. 218, Khesara No. 57, Rakba 0.5 decimal and Khata No. 218, Khesera No 58, Rakba 55 decimals and Khata No. 218, Khesera 59, area 14 decimal (i.e. total area 74 decimal land) Chandpur Marg Mile Serial No. 06, 07 block Rupauli, District Purnea as well as land of petitioner which has not been paid by the respondents even after lapse of more than 50 years and also direct the respondents either to pay compensation amount as per current valuation of the land or as per compound interest of Bank from the date of acquisition of the land till final payment of land-in- question or direct the respondent authority to make free the land which has acquired by the respondents without paying any amount to the petitioner and/or pass any order/

orders, direction/directions for which the writ petitioner is legally found entitled in the facts and circumstances of the case stated hereinafter.”

3. If the contention of the petitioner is to be accepted, it is unfortunate that despite the acquisition made in the year 1976-77, he has not received a single penny.

4. Learned counsel for the petitioner submits that it is a fit case where he should make a prayer for reclaiming the land for want of compensation amount.

5. Learned State counsel submits that similar such cases are also pending earlier and it will suffice if the matter is taken up by the Collector, Purnea (respondent no. 3).

6. The contention of the petitioner and the unfortunate state of affairs in the district of Purnia already stands recorded.

7. If the contention of the petitioner that for the last 50 years, no compensation amount has been paid despite his claim having been found correct by the respondents to receive the compensation, it is high time that the Collector, Purnia takes the matter to its logical conclusion.

8. Once this petition is preferred in next four weeks, the Collector, Purnea will not limit himself/herself to this petition only and he/she will be taking up the other cases relating to said acquisition to the construction of State Highway 65 (Purnia-Harnaha-Chandpur Marg Mile-Rupauli-Tikkapatti Road) also each and every such stakeholder who has been denied compensation (whose land taken) be considered so that the Patna High Court is not flooded with the same prayer by similar situate litigants every now and then.

9. The entire process is to be completed by 31st of December, 2026 and if the petitioner and others are entitled to the compensation amount, it has to be cleared by 31st of March, 2027.

10. With the aforesaid observation, the writ petition stands disposed of.
