ORAL ORDER

17-08-2026 Heard Mr. Surendra Kishore Thakur, learned counsel for the petitioner and the State.

2. The present petition has been preferred for the following relief(s): “(i) For issuance of a writ in the nature of certiorari for setting aside/quashing the impugned order dated 07/02/2026 passed by the Deputy Collector Land Reforms (DCLR), Darbhanga in Mutation Appeal No. 1162/2024-25 whereby and where under the Deputy Collector Patna High Court CWJC No.5784 of 2026(3) dt.17-08-2026

Land Reforms has allowed the mutation appeal setting aside the previous order dated 27/09/2023 passed in Mutation Case No. 1506/2023-24, completely ignoring Section 6(12) of the Bihar Mutation Act 2011, which imposes restrietions on the alteration of mutation records during the pendency of a Title Suit.

(ii) For a direction to the respondent authorities not to correct the mutation record or expunge the name of the petitioner till the pendency of the Title Suit.

(iii) For any other relief or reliefs which this Hon'ble Court may deem fit and proper.”

3. After some argument, learned counsel for the petitioner submits that it will suffice if his case is considered by the District Magistrate, Darbhanga (respondent No. 2).

4. Learned counsel representing the State have no objection to it.

5. In that background, the writ petition stands disposed of allowing the petitioner to approach the District Magistrate, Darbhanga (respondent No. 2) within a period of four weeks who shall be duty bound to look into the matter and Patna High Court CWJC No.5784 of 2026(3) dt.17-08-2026

pass an appropriate order, after hearing all the necessary parties, in accordance with law, preferably within a period of six months thereafter.
