ORAL ORDER

17-08-2026

1. Heard learned counsel for the petitioners and learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 118(2), 74, 109, 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner Nos.

2, 3 and 4 are women and the informant alleges that on 26.05.2026 at 03:00 PM her son (Amit) was conducting coaching classes in a rented premise, when accused persons including the petitioners came and abused and objected the coaching class, despite landlord informing the accused persons that the premise has been rented to Amit, further accused persons assaulted Amit and Bipin assaulted by axe causing injury on head of Amit and he became unconscious, it is next alleged that accused persons dashed informant’s daughter on ground, thereafter Sunil assaulted by axe causing injury on her hand, further rest accused assaulted the students, it is further alleged that Sunil also assaulted Praveen by axe causing injury on hand.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is further submitted that it is not in dispute that the coaching classes are being run in a rented premise, but then students who come for coaching passed obscene comments and acted inappropriately with the female members of the family of the petitioners, as such, the male members had gone to object when an altercation took place and both sides assaulted each other, it is further submitted that from side of the petitioners four persons received grievous injury, it is also submitted that the female members have been implicated only with an intent to coerce the male members into submission, it is next submitted that it absolutely does not stand to reason that as to why the petitioners would have gone to the coaching institute to raise an objection, the reason was obvious that side of the petitioners were not feeling safe on account of inappropriate behaviour of student who used to come to the coaching institute. It is also submitted that petitioners are not criminals.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioners, but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that from side of the petitioners four persons suffered grievous injury.
