ORAL ORDER
17-08-2026 Heard Mr. Onkar Nath, learned counsel for the petitioner and the learned counsel representing the State.
2. The present petition has been preferred for the following relief/s:
(i) commanding the respondent authorities particularly the Respondent No. 7 to keep in abeyance the entire process concerning to the Mutation Case No.- 3176/2026-2027 dt.-22.07.2026 pertaining to Mauza-Baijalpur of Paru- Anchal of Dist.-Muzaffarpur, Revenue Thana No.- 311, R.S. Khata No.-26 Ka, Plot No.-166 for an area of 18 decimal & Plot No.-167 for an area of 5 decimal, 3177/2026-2027, dt.- 22.07.2026 pertaining to Mauza-Baijalpur of Paru-Anchal of Dist.- Muzaffarpur, Revenue Thana No.-311, R.S. Khata No.-26 Ka, Plot No.-635 for an area of 22 decimal &
3178/2026-2027,
dt.-22.07.2026, pertaining to Mauza- Baijalpur of Paru- Anchal of Dist.-Muzaffarpur, Revenue Thana
No.-311, R.S. Khata No.-26 Ka, Plot No.-879 for an area of 1.5 decimal during the pendency of Title Suit No.-888 of 2026 pending subjudice before the learned court of Sub-Judge-1st (West), Muzaffarpur.
(ii) further commanding the respondent authorities particularly the Respondent No. 7 to consider the objection/s dt.-27.07.2026 in connection with Mutation Case No.- 3176/2026-2027, 3177/2026-2027 & 3178/2026-2027.
(iii) further commanding the respondent authorities particularly the Respondent No. 7 to follow with the provisions of Bihar Land Mutation Act, 2011 & the Mutation Rules, 2012.
(iv) for grant of any other incidental/consequential relief/reliefs, for which the petitioner can be found entitled for.
3. After some argument, learned counsel for the petitioner submits that it would suffice if the Circle Officer,
Paru, Muzaffarpur, Bihar (respondent no.7) takes up the matter, considers it and passes an order.
4. Learned State Counsel has no objection.
5. In that background, CWJC No.12382 of 2026 stands disposed of allowing the petitioner to approach the Circle Officer, Paru, Muzaffarpur, Bihar (respondent no.7) within four weeks and he shall be duty bound to take up the matter to its logical conclusion after hearing all the necessary parties at an earliest.
